• Introduction These terms and conditions govern the use of the services provided by Expatria Portugal, hereafter referred to as "the agency", to clients seeking to purchase a property in Portugal.
• Services Offered The agency provides a range of services to assist clients in purchasing a property in Portugal. These services include property search, property viewings, negotiation, legal assistance, and financing assistance. The agency's services are provided on a non-exclusive basis, meaning that clients are free to use the services of other agencies and providers if they wish.
• Fees The agency charges a fee for its services, which is agreed upon in advance with the client and will vary depending on the type of service(s) agreed upon. In addition to this fee, a commission payment may be applicable depending on the house valuation, which is payable once the CPCV contract has been signed. The agency will provide a written quote for its services before commencing work for the client.
• Client Obligations Clients must provide accurate and complete information to the agency, including details of their property requirements, budget, and any other relevant information. Clients must also act in good faith and cooperate with the agency in its efforts to assist them in purchasing a property in Portugal.
• Liability The agency will use its best efforts to provide accurate and up-to-date information and advice to clients, but cannot be held responsible for any errors or omissions. Clients are responsible for conducting their own due diligence on any property they wish to purchase, and the agency does not assume any liability for the suitability or condition of any property.
• Confidentiality The agency will keep all client information confidential and will not disclose it to any third party without the client's express consent, except where required by law.
• Termination Either party may terminate the agency's services at any time by providing written notice to the other party. If the agency has already provided services to the client, the client may be liable for payment of any fees due for those services.
• Governing Law These terms and conditions are governed by the laws of Portugal and any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Portugal.
• Amendments The agency may amend these terms and conditions at any time by providing written notice to the client. Any changes will become effective immediately upon notice.
• Entire Agreement These terms and conditions constitute the entire agreement between the agency and the client and supersede any prior agreements or understandings, whether written or oral.
